Government to High Court: AG’s firing must be upheld to avoid ‘anti-democratic form of government’

The government requests that the High Court of Justice reject petitions against its decision to fire Attorney General Gali Baharav-Miara, and that it annul its interim decision suspending the attorney general’s dismissal.

Justice Minister Yariv Levin and Diaspora Affairs Minister Amichai Chikli accuse Baharav-Miara of “working systematically against the elected government that it is her job to assist.”

They argue that there is no doubt that there are substantive and ongoing differences of opinion between the attorney general and the government that prevent effective collaboration, one of the primary causes for dismissal.

“The court must not assist the petitioners and Baharav-Miara in creating this original, anti-democratic form of government,” they say in their filing.

The High Court has expressed strong reservations over the manner in which the government fired the attorney general, particularly the manner in which it changed the dismissal process because it had been unable to fire her through the original process laid out in a cabinet resolution in 2000.

The court is expected to issue a final ruling in the coming months.
